1.Scope of this personal data protection policy

This personal data protection policy applies to all content, services and advice (information services, symposiums, congresses, conferences, events, webinars) offered through all websites, social network accounts and paper media belonging to PERSONNALITÉ (hereinafter “PERSONNALITÉ”), which would collect personal data (hereinafter collectively the “Services”). Consequently, this policy does not apply to third-party websites/mobile applications/social media accounts/paper media and the Services offered by them.

PERSONNALITÉ complies with French regulations relating to the protection of personal data (including the amended law of January 6, 1978 relating to data processing, files and freedoms) as well as Regulation 2016/679 of April 27, 2016 (hereinafter, the “GDPR”).

This personal data protection policy applies in addition to the General Conditions of Use of PERSONNALITÉ Services when they exist.

2.Collection of data that you transmit to PERSONNALITÉ

As a data controller within the meaning of the GDPR, PERSONNALITÉ is responsible for the personal data it collects.

The personal data that you provide by filling in computer and paper forms, by subscribing to online services, by uploading content online, or by sending PERSONNALITÉ directly emails, paper letters, etc. :

Family name first name ;
Email addresses;
Sex;
Phone numbers ;
Postal addresses;
Photographs; videos;
Your opinion on the Services;
Any special request that you may send to PERSONNALITÉ (mainly for archiving purposes and to process your request);
Professional functions;
Curriculum vitae ;
IP adress ;
Type of organization (company, school, university, etc.), name of organization, size of organization, department and job title;
Data not collected directly from you: PERSONNALITÉ may collect personal data about you from third parties. These sources are public and non-public. PERSONNALITÉ will not fail to communicate to you, during the first communication, all the information on the processing and the source of the data as well as any useful information regarding the exercise of your rights of opposition, erasure, limitation , access, rectification and portability as well as the fate of data after death.

4.Purposes of collecting and processing your personal data

The use of your personal data that you transmit to PERSONNALITÉ, with your prior consent when required, is done within the following framework:

for the provision of the Services free of charge;
allow you to request and obtain information about the company and its Services;
allow you to open and manage an account/profile in order to obtain the necessary materials (pdf, video, etc.) for the use of the Services and technical assistance;
allow you to subscribe to the Services;
allow you to register for seminars, conferences, webinars or other events;
allow you interactive and personalized use of PERSONNALITÉ websites and third-party applications;
shape the PERSONNALITÉ websites so that they are the most suitable for your use and your terminal;
identify your needs and areas of interest and provide you with the most suitable Services;
allow PERSONNALITÉ to manage surveys and polls aimed at improving the Services and their content; protect you against fraudulent actions;
to send you regular news and information about the Services, brands, operations and/or PERSONNALITÉ websites and social media accounts that may interest you as well as to send you reports of events of PERSONNALITÉ;
to respond to any request from public and/or judicial authorities and in particular to communicate usage data at the request of a judicial authority in accordance with legal provisions.
Promotional emails: in accordance with applicable legislation and with your consent when required (which the company collects through an opt-in), PERSONNALITÉ may use the data you provide to it on its websites and print media to for commercial prospecting purposes under the conditions of article L.34-5 of the Postal and Electronic Communications Code, for example to send you its newsletters, send you invitations to its events, offer you offers from its partners or any other communication that may be of interest to you. 5.Duration of retention of your personal data

The retention period of your personal data may vary depending on the purpose of the collection. The retention period for your personal data will be 5 years after the end of the commercial relationship with PERSONNALITÉ (or the last contact from you if you are a simple prospect). At the end of this 5-year period, PERSONNALITÉ may contact you again to find out if you wish to continue to receive commercial solicitations. In the absence of a positive and explicit response from you, the personal data will be deleted or archived in accordance with the provisions in force.

Please note that PERSONNALITÉ may retain certain personal data about you when required by law or when PERSONNALITÉ has a legitimate reason to do so. This is the case, for example, if PERSONNALITÉ believes that you have committed fraud or violated the General Conditions of Use of Services and Sale.

The information stored in your terminal (eg cookies), or any other element used to identify you and allowing their traceability as well as the raw attendance data associating an identifier, will not be kept beyond thirteen months.

6. Recipients of your personal data

The Personal Data collected is intended for PERSONNALITÉ.

Your personal data is not communicated to third parties, except in the following cases:

when you have given your prior consent to the sharing and/or disclosure of your personal data, including through the features offered as part of the Services;
when PERSONNALITÉ must share your personal data with business partners (as previously authorized by you), suppliers, service providers and in particular technical service providers for the purposes of providing the Services, solving problems with the operation of the Services or even with a view to offer promotional information in relation to the Services offered by PERSONNALITÉ;
PERSONNALITÉ may be required to transmit your personal data to subcontractors, in particular for the processing of payments, the analysis of data, the processing of mailing campaigns, the management of information flows for subscriptions and renewals, the hosting the Services, processing certain marketing aspects of the Services;
PERSONNALITÉ may be required to communicate your personal data to third parties pursuant to a law, a regulation or pursuant to a decision of a competent regulatory or judicial authority or, if necessary, for the purposes to preserve its rights and interests;
in the event of a change of control of PERSONNALITÉ or the transfer of all or part of its assets, PERSONNALITÉ will be authorized to transfer your personal data.
PERSONNALITÉ does not transmit your personal data to third party advertisers for targeted marketing purposes unless you have given your prior consent. PERSONNALITÉ may use and share with third parties certain non-personal technical or aggregated data relating to your browsing on PERSONNALITÉ websites. The collection, processing and disclosure of such anonymized data shall not be subject to the restrictions set forth herein.

7.Storage/hosting of your personal data

Your personal data is stored/hosted either on PERSONNALITÉ’s servers or on the servers of its service providers located within the European Union.

8.Security of your data

PERSONNALITÉ implements security measures to preserve the security of your personal data. PERSONNALITÉ uses encryption to protect sensitive information transmitted online (https browsing, etc.). Only employees who need to perform a specific job (for example, billing or customer service and subscription service) have access to personal data. The storage of personal data is carried out in secure environments.

In addition, PERSONNALITÉ websites may contain links to third party websites, which are governed by their own privacy policies, terms of use and security measures, which may differ from those of PERSONNALITÉ.

PERSONNALITÉ cannot be held responsible for the content and practices of these websites. This is why it is recommended to consult their privacy policy before transmitting any data to them.

9.CNIL and RGPD: Right of access, rectification, erasure, opposition, data portability and limitation of processing as well as the fate of data after death

In accordance with French law relating to the protection of personal data and the GDPR, you have rights of access, rectification, erasure, opposition, as well as rights to the portability of your personal data and to the limitation treatments as well as the fate of these same data after death. These different rights can be exercised with the controller, PERSONNALITÉ.

You can exercise your rights of access, modification (if you detect an error in entering your data or if you consider it incomplete or ambiguous) and opposition.

You also have the right to the portability of your data, i.e. the right to receive the personal data that you have provided to PERSONNALITÉ in a structured, commonly used format (Excel spreadsheet file for example) and readable by a machine and that they are transmitted to another controller for processing carried out using automated processes for which you have given your consent.

You can provide PERSONNALITÉ with instructions regarding the storage, erasure and communication of your personal data after your death.

You can ask PERSONNALITÉ to delete any personal data that concerns you and that PERSONNALITÉ holds. However, please note that PERSONNALITÉ may keep a record of your data for archival purposes (in particular when required to do so by law).

Finally, in accordance with Article 18 of the GDPR, you may also request to limit access to processing, for example:

when the accuracy of your personal data is contested by you – and this, for a period allowing PERSONNALITÉ to verify the accuracy of your personal data;
when PERSONNALITÉ no longer needs your personal data for the purposes of processing but they are still necessary for you to establish, exercise or defend your rights in court.

For your complete information, you have the option of contacting the National Commission for Computing and Liberties (whose contact details are at https://www.cnil.fr/) in the event that PERSONNALITÉ would not have followed up on your request within one month of receiving it. If necessary, this period may be extended by two months, taking into account the complexity and the number of requests.
